1. Data controller
The controller responsible for processing personal data through this website is:
Sekar Rajagopal
Im Hilgenfeld 12
60433 Frankfurt am Main
Germany
Email: mail@sekar.de
Telephone: +49 151 436 777 77

2. Visiting the website and server log data
When you access the website, technical data may be processed by the web server to deliver pages and maintain availability and security. Depending on the server configuration, this may include your IP address, date and time of access, requested page or file, referrer URL, browser and operating-system information, and server response status.
The legal basis, insofar as personal data is processed for secure and reliable website operation, is Article 6(1)(f) GDPR (legitimate interests). For activities necessary to provide a service expressly requested by you, Article 6(1)(b) GDPR may also apply.
The website is hosted by ALL-INKL.COM – Neue Medien Münnich, Germany. Hosting providers may process technical information on behalf of website operators. Relevant contractual safeguards, server-log retention periods and any additional hosting services should be confirmed with the provider.
3. Contact form, email and telephone enquiries
If you contact me using the website form, by email or by telephone, I process the information you provide—such as your name, email address, contact details, subject, message and relevant correspondence—to respond to your enquiry. The contact form is intended for artwork enquiries, commissioned paintings and related professional communication.
The legal basis is Article 6(1)(b) GDPR where the communication concerns a potential or existing contract, or Article 6(1)(f) GDPR for other legitimate professional enquiries. Information is not sold to advertisers.
Enquiries are retained only for as long as necessary for the relevant purpose, unless statutory record-keeping duties, disputes or other lawful grounds justify further retention. Please avoid including sensitive personal or payment information in the contact form.
4. Artwork purchases and commissioned paintings
If you purchase a painting or arrange a commission, I may process your name, billing and delivery details, contact information, agreed artwork specifications, transaction details and correspondence to prepare offers, perform agreements, arrange delivery and meet tax and accounting obligations.
The legal bases are Article 6(1)(b) GDPR (contract and pre-contractual steps) and Article 6(1)(c) GDPR (legal obligations). Where needed, the information may be shared with shipping companies, payment providers, accountants or public authorities, limited to what is required for the relevant purpose.
Business records are retained for the periods required under applicable German tax and commercial law; different categories of records may be subject to different statutory retention periods.
5. Cookies, local storage and similar technologies
German law protects information stored on or accessed from visitors' devices. Under Section 25 of the German Telecommunications Digital Services Data Protection Act (TDDDG), consent is generally required for non-essential cookies or comparable technologies. An exception applies where storage or access is strictly necessary to provide a service expressly requested by the visitor or to transmit a communication.
Where personal data is processed, the GDPR applies in addition. Technically necessary processing may rely on an appropriate lawful basis under Article 6 GDPR. Non-essential analytics, advertising, personalization or comparable tracking must not be activated before any legally required consent has been obtained.
Cookie declaration: The cookies and technologies actually used by this website, including their provider, purpose and duration, must be determined from the live website configuration. This page does not itself activate cookies or collect consent. If optional technologies are added, this notice must be updated and an appropriate consent mechanism introduced before their use.
6. External links and WhatsApp
This website may contain links to external services, including WhatsApp. Clicking a WhatsApp link takes you to a service operated by WhatsApp/Meta, which processes data under its own privacy terms. Merely including an ordinary external link does not itself require the visitor to use that service. You may instead contact me directly by email or telephone.
Other third-party websites linked from this site are responsible for their own data practices.
7. Third-party content, analytics and social media
If external fonts, videos, maps, embedded social-media content, visitor analytics or advertising tools are integrated into the website, the associated providers may receive technical or personal data. Such services require their own assessment, appropriate privacy disclosures and, where necessary, consent before they are loaded.
No statement in this policy should be interpreted as confirming that a specific analytics or tracking service is active. The actual scripts, embeds and hosting configuration must be reviewed before publication.
8. Data recipients and international transfers
Personal data is shared only where necessary for hosting, communication, the processing of artwork transactions, delivery, legal compliance or the protection of legitimate interests. Where service providers process personal data on my behalf, appropriate data-processing arrangements are used as required by law.
If personal data is transferred outside the European Economic Area, the applicable requirements of Chapter V GDPR must be met, for example through an adequacy decision or suitable safeguards. Transfers depend on the services actually used.
9. Your rights under the GDPR
Subject to the applicable legal conditions, you may request access to your personal data (Article 15), rectification (Article 16), erasure (Article 17), restriction of processing (Article 18), data portability (Article 20) and object to certain processing (Article 21). Where processing is based on consent, you may withdraw it at any time with effect for the future (Article 7(3)).
To exercise these rights, contact mail@sekar.de. You also have the right to lodge a complaint with a competent data-protection supervisory authority, including the Hessian Commissioner for Data Protection and Freedom of Information (datenschutz.hessen.de).
10. Data security
Reasonable technical and organizational safeguards are used to protect personal data against unauthorized access, loss or misuse. Data transmission over the internet can never be guaranteed to be entirely risk-free. Do not send payment-card information or other highly sensitive information via a general enquiry form.
11. Changes to this privacy policy
This policy may be updated if the website, processing activities or applicable legal requirements change. The current version will be published on this page with an updated date. Questions about privacy can be sent to mail@sekar.de.
